Nothing wrong with arrest of judges-Lai Mohammed

The Minister of Information, Alhaji Lai Mohammed on Wednesday said there was nothing wrong in the arrest of judges’ in the fight against corruption.
Briefing State House correspondents at the end of Federal Executive Council (FEC) meeting presided by President Mohammadu Buhari,he said:
“What the government is concerned and passionate about is to fight corruption. In the process of fighting corruption, it is not unusual that you step on some very sensitive toes but the question to ask and I think these has been adequately answered by the Attorney General is that let’s remove emotion from facts.
“One, do judges have immunity? The answer is no. Can judges be arrested? The answer is yes. Have judges that are serving been arrested in Nigeria? The answer is yes. Justice Okoli had been arrested and tried.
“Now the next question to ask is what is the proper procedure for arresting anybody including judges? There must be properly executing of the search warrant. Was such presented? The answer again is yes. People have tried to muddle the facts about when do you search the person’s house, the truth of the matter is that under the new criminal justice law, you can search anybody, anywhere, anytime.
“Again they have tried to muddle issues by trying to say that the NJC is the only authority that can attend complain and discipline, the answer once again is no,” he added.
He continued
“Some people are saying oh, the reason why they went to some particular judges house is because the President wants somebody from one part of the country to be Chief Justice of Nigeria. I think that is preposterous.
“I want to assure you that this government has no intention to humiliate the judiciary and for those who are talking about separation of power, I think you are stretching it too far. I and members of the Executive, I can be invited by any arm of the government and I will go. So I think we should situate this thing in the right perspective.” He added
He recalled when 22 out of 32 judges in Ghana, who were caught on tape by journalists asking for a bribe, were dismissed in 2015.
He added: “Yes it’s true that what is happening today has probably never happened at this level before but frankly speaking and with all due respect we do not intend to humiliate any judge, we have no intention to humiliate the judiciary but believe me what we have done we have done within the ambits of the law.
“I think the Federal Government is being very careful with handling of this particular issue, I want to state clearly that this government believes very much in separation of powers, this government has a lot of respect for the judiciary and for obvious reasons, not just because the constitution says so but I think probably this is one cabinet that has the highest number of lawyers as ministers.
“As at the last count about eleven or twelve council members are lawyers and we have female lawyers also in the cabinet until death robbed us of late Ocholi we had five SANs in our cabinet and I think this is unique, therefore you can understand the kind of respect we have for the judiciary.”
He also pointed out that the President himself, who sought to be President four times and had it thwarted three times, took his case to court on the three occasions.
“He took his case to the judiciary, so I can say clearly that this administration has a lot of respect for the judiciary and I think I stand by what Mallam Garba Shehu said that please do not confuse the fight against corruption as a fight against judiciary,” he added

Police/DSS Operatives manhandle Governor Wike in failed attempt to abduct a Federal High Court Judge

Governor Wike alleges plot to declare state of emergency in Rivers State. According to a statement signed by Special Assistant to the Rivers State Governor, Electronic Media, Simeon Nwakaudu, the illegal siege on Rivers State by Federal eecurity agencies continued unabated during the early hours of Saturday as hundreds of Department of State Services (DSS) operatives and policemen attempted to illegally abduct a Federal High Court judge residing at Number 35 Forces Avenue in Port Harcourt.
The illegal failed abduction was led by Mr Tosin Ajayi, Rivers State Director of the Department of State Services (DSS) and Rivers State Police Commissioner, Mr Francis Odesanya.
The operatives of DSS reportedly rough-handled Governor Wike, pushing him around and injuring his hand. A few of the operatives cocked their rifles and threatened to shoot the Governor.
They were irked by Governor Wike’s arrival at the scene shortly after the failed abduction process began. It was learnt that Governor Wike received security information on the illegal moves, minutes after the operation started.

The security operatives blocked the entrance of the residence of the Federal High Court judge at about 1am on saturday morning, claiming that they were acting on orders from above. As they dragged Governor Wike, they insisted that they must be allowed to leave with the judge.
However, the commotion attracted passers by and journalists who thronged the vicinity to know why hundreds of security agents in several Patrol vans had been mobilised.
Upon the arrival of the national media, the Rivers State Director of the DSS, Mr Tosin Ajayi jumped into his vehicle and fled the scene.
However, addressing journalists, Rivers State Police Commissioner, Francis Odesanya said the two security agencies were at the scene because they received privileged information.
Odesanya claimed he was at the scene as a peace maker. He declined comments on why the Police joined the DSS to abduct a serving Federal High Court judge.
In an interview with journalists at the scene of the failed illegal abduction of a Federal High Court judge by the Police and DSS, Governor Wike said it will not be under his watch that security agencies wiĺl be allowed to entrench needless impunity.
He declared that their reckless action portends danger to the nation’s democracy, noting that he is convinced that President Buhari is not aware of the level of impunity being perpetrated by Federal Securiy agencies.

Governor Wike stated that whatever the situation, the rule of law must prevail in a democratic setting.
He said if the security agencies had a lawful directive to implement, they must follow due process .
According to him:
“Not under my watch wiĺl I allow this kind of impunity to take place. That is why we are here. I don’t know which judge they were detailed to abduct. I didn’t bother myself to know which judge. All I am interested in is that, at this level, it is not allowed.
“He is not a criminal and he is not an armed robber. If the person has committed an offence, invite him. It is only when he refuses to honour the invitation that you can adopt this commando style.
“The Commissioner of Police is here, the Director of DSS is here. Their operatives cocked their guns and threatened to shoot me. I have never seen that before. Again , this is to tell you what we are facing . We know that more will come. For us in this state, we shall continue to resist it.”
Governor Wike added:
“It doesn’t matter what it will cost. When you talk about liberty, sacrifices must be made. We are not trying to stop an arrest. All we are saying is that things must be done decently and in line with the rule of law.
“Rivers State is under siege. For you to see a governor out at this time of the day, something is wrong. A siege is an understatement. If this type of thing happens next time, the people wiĺl resist it to the last”.
The governor stressed:
“They are trying to do something funny in this state, probably to declare a state of emergency.

Judges Crackdown Confirms Judiciary A Major Concern For Buhari

A Bauchi-based legal practitioner, Barr. Abdull Malle, has described as “hasty”, the reaction of the Nigeria Bar Association (NBA) over the crackdown on some judges by the Department of State Security Service (SSS).
In an interview in Bauchi on Monday, Malle said the association ought to have taken its time to study the situation carefully before threating the authorities on the issue.
He said although judges were protected within the confines of their duty-post, they could be investigated on behaviours that ran foul of the law, once due process was followed.
According to him, if the investigating authority has been granted search permit by a court of competent jurisdiction, the action of such authority is covered by law.
He therefore advised that the matter be treated with caution in view of its sensitive nature and implication on the image of the Judiciary.
Meanwhile, some residents of Bauchi, Gombe and Yola have hailed the action taken by the Department of Security Services in cracking down on suspected corrupt judges. They said that the anti-corruption drive of the Federal Government should be ‘all embracing’.
They said that with the trial of some members of the National Assembly and the current move on the suspected judges, it had become clear that there could be no ‘sacred cows’ in the anti-corruption crusade.
According to them, such move will clear all doubts in the minds of some people about the nobble intention of the present administration to rid the country of corruption.
Malam Usman Aliyu, a civil servant with Bauchi state government, said the measure had made him to have faith in the exercise.
“In the past, the war was just a sweet melody without action; no big fish was ever caught in the net but the story is different today”, he said.
He urged the antigraft agencies to disregard the threat of the Nigeria Bar Association on the matter, describing their action as selfish.
Timothy Abraham, a businessman in Bauchi, noted that the recent clampdown on judges confirmed an earlier complaint by President Buhari that his major headache as far as the anti-corruption fight was concerned, was the Judiciary.
He said any attempt by an individuals or association to scuttle the crusade should be viewed seriously by all well-meaning Nigerians.
He however advised that due process be followed in bringing culprits to justice so as not to give room for any complaints from people with vested interests.
Another resident of Bauchi, Aliyu Bala, a federal civil servant, noted that the sectors considered as ‘untouchable’ had so far been ‘touched’, as such the anti-graft war was on the right course.
“There should be no hiding place for any person, no matter his personality or association; what is happening today gladdens my heart.
“Anybody that is not happy or tries to become a stumbling block, means he or she encourages corruption; it is left for Nigerians to know how to handle him,” he said.
In Gombe, Alhaji Mohammad Wayas, North East Zonal Chairman of Human Rrights Coalition, a non-governmental organization, said that the Federal government was moving in the right direction. According to him, the Judges arrested are not above the law, hence the need for the government to handle them accordingly to serve as lesson to others.
Malam Abubakar Ibrahim, another Gombe resident and a civil servant, urged the Federal government to ignore any threat and ensure that justice was done in the case.
He commended President Muhammadu Buhari for taking the anti-graft fight to the door-steps of individuals considered as ‘untouchable’ in the past.
Malam Muazu Umar, another Gombe resident, expressed dismay over the threat of the NBA and called for thorough screening of legal practitioners with doubtful character.
In Yola, cross section of commercial drivers and cyclists who spoke to NAN said they were in support of Federal Government’s move to cleanse the Judiciary of bad eggs.
“I am in full support of the move to sanitize the Judiciary and there should be no scared cow.
“If politicians and military men are being arrested for corruption, Judges should not be excluded,” Musa Habu, a driver said.
Habibu Danjuma and Kabiru Mubi, tricycle operators, also declared support for the arrest of the Judges, saying the measure had gone a long way in convincing Nigerians that the Buhari administration was committed to the anti-graft war.
“It’s now that I am convinced that Buhari is committed to fighting corruption; we are with him on this; we voted for him for such change,” Danjuma said.

Mutilated currency scam: Banker jailed 10 years, to forfeit property

Justice Joyce Abdulmalik of the Federal High Court, Ibadan, on Friday sentenced one Ademola Adedapo to 10 years in prison for his involvement in the N8 billion mutilated currency scam.
The judge held that Adedapo was convicted based on a plea bargain agreement he signed with the Economic and Financial Crimes’ Commission (EFCC).
The judge said the court found Adedapo guilty of five- count charge brought against him by the EFCC based on the agreement.
“Adedapo is hereby sentenced to two years in prison for each of the offence of conspiracy and the sentence commences from February 7, 2015,” the News Agency of Nigeria (NAN) quoted the judge as saying on Friday.
“The property mentioned in the plea bargain as stated therein which include; hectares of land, car, building and the over N44 million found in his account, will all be forfeited to the Federal Government of Nigeria.
“His International passport shall be seized until he completes his jail terms and the jail terms are to run concurrently.”

A High Court of the Federal Capital Territory (FCT) in Jabi, Abuja, has discharged the Senate President, Bukola Saraki; Deputy Senate President, Ike Ekweremadu and two other persons arraigned for forging the Senate Standing Orders 2011.
The two other persons are – former Clerk of the National Assembly, Salisu Maikasuwa, and a former Deputy Clerk, Ben Efeturi,
Justice Yusuf Halilu, in a ruling on Friday, accepted the application filed by lead prosecution lawyer, Aliyu Umar (SAN), seeking the withdrawal of the charge against the defendants over a pending suit before the Federal High Court, Abuja, on the same matter.
Umar told the court that because of the pending case at the Federal High Court, involving Saraki and Ekweremadu, the prosecution decided to withdraw the older charge and the amended one filed on October 5 (Wednesday).
“This government respects the rule of law and the hierarchy of the judiciary. It is obvious from these two applications (filed by Saraki and Ekweremadu) and the similar case before your learned brother, Justice Kolawole, at the Federal High Court, who is dealing with the issue, that we are withdrawing the charges.
“It is trite that two matters of the same subject matter cannot be before different courts of coordinate jurisdiction. Therefore, the amended charge dated October 5, 2016 and also the original charge dated June 10, 2016 and filed the same date, be struck out and all the four defendants be discharged,” Umar said.
Lawyers to the defendants,  Paul Erokoro (SAN), Joseph Daudu (SAN), Ikechukwu Ezechukwu (SAN) and Mahmud Magaji (SAN),  did not object to Umar’s application to withdraw the charge, following which Justice Halilu struck it out and discharged the defendants.

Money laundering: Jonathan’s ex-aide loses bid to nullify guilty plea

A former Special Adviser on Domestic Affairs to ex-President Goodluck Jonathan, Waripamo Dudafa, on Friday lost his bid to nullify the guilty plea by four companies linked to Jonathan’s wife, Patience.
Justice Babs Kuewumi dismissed the application because it was unmeritorious.
The companies, on September 15, pleaded guilty to laundering $15,591,700 (about N5 billion) when they were arraigned.
They are – Pluto Property and Investment Company Limited (represented by Friday Davis), Seagate Property Development and Investment Company Limited (represented by Agbor Baro), Trans Ocean Property and Investment Company Limited (represented by Dioghowori Frederick) and Avalon Global Property Development Limited (represented by Taiwo Ebenezer).
Mrs. Jonathan claimed the monies in the companies’ accounts were hers.
The companies, along with a lawyer Amajuoyi Briggs and a banker, Adedamola Bolodeoku, were arraigned before Justice Babs Kuewumi.
Dudafa, Briggs and Bolodeoku, however, pleaded not guilty to a 17-count charge brought against them by the Economic and Financial Crimes Commission (EFCC).
Dudafa and Briggs, through their lawyers, later urged the court to set aside the guilty plea entered on the firms’ behalf by their representatives.
They urged the court to replace the guilty plea and with a “not-guilty” plea for the companies.
They also contended that the court lacks the jurisdiction to accept the companies’ guilty plea.
The defendants said those who pleaded guilty for the companies did not exhibit any letter authorising them to do so by the firms’ board.
They argued that the prosecution failed to comply with Section 477(3) of the Administration of Criminal Justice Act, 2015 which specifies that such a representative must have authorisation.
