12 Steps To Impeach The President According To The 1999 Constitution


There have been reports that some members of the Nigerian upper legislative chamber have threatened President Muhammad Buhari with impeachment.
The process of impeaching a Nigerian president is rather long winding and complex. In this light, INFORMATION NIGERIA brings you, the procedure for removing the president of Nigeria from office as  stated clearly in Section 143 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) .

1.There must be a notice of any allegation in writing signed by not less than one-third of the members of the National Assembly.
2.The Notice of Impeachment requires the signature(s) of at least one-third (1/3) of all the members of the National Assembly. That means among the 469 members in the National Assembly. A minimum of 157 members of the National Assembly must sign the notice to commence the process.
3.It is then presented to the president of the senate in this case Bukola Saraki, stating that the holder of the office of President is guilty of gross misconduct in the performance of the functions of his office, detailed particulars of which shall be specified.
4.The President of the Senate shall within seven days of the receipt of the notice cause a copy thereof to be served on the holder of the office and on each member of the National Assembly, and shall also cause any statement made in reply to the allegation by the holder of the office to be served on each member of the National Assembly.
5.Within fourteen days of the presentation of the notice to the President of the Senate (whether or not any statement was made by the holder of the office in reply to the allegation contained in the notice) each House of the National Assembly shall resolve by motion without any debate whether or not the allegation shall be investigated.
6. A motion of the National Assembly that the allegation be investigated shall not be declared as having been passed, unless it is supported by the votes of not less than two-thirds majority of all the members of each House of the National Assembly.
7. Within seven days of the passing of a motion under the foregoing provisions, the Chief Justice of Nigeria shall at the request of the President of the Senate appoint a Panel of seven persons who in his opinion are of unquestionable integrity, not being members of any public service, legislative house or political party, to investigate the allegation as provide in this section.
8. The President whose conduct is being investigated under this section shall have the right to defend himself in person and be represented before the Panel by legal practitioners of his own choice.
9.A Panel shall be appointed which shall;
(a) have such powers and exercise its functions in accordance with such procedure as may be prescribed by the National Assembly; and
(b) within three months of its appointment report its findings to each House of the National Assembly.
10. Where the Panel reports to each House of the National Assembly that the allegation has not been proved, no further proceedings shall be taken in respect of the matter.
11. Where the report of the Panel is that the allegation against president has been proved, then within fourteen days of the receipt of the report at the House the National Assembly shall consider the report, and if by a resolution of each House of the National Assembly supported by not less than two-thirds majority of all its members, the report of the Panel is adopted, then the holder of the office shall stand removed from office as from the date of the adoption of the report.
12. No proceedings or determination of the Panel or of the National Assembly or any matter relating thereto shall be entertained or questioned in any court.
And according to the constitution “gross misconduct” means a grave violation or breach of the provisions of this Constitution or a misconduct of such nature as amounts in the opinion of the National Assembly to gross misconduct.

Senator Melaye Refutes Reports About Insulting Mrs Tinubu



Sahara Reporters a New York based online news platform had reported yesterday that Senator representing Kogi West, Dino Melaye had threatened to ‘impregnate’ Remi Tinubu, the wife of the All Progressives Congress (APC) National Leader. The Senator, however took to his Twitter handle saying that Sahara Reporters are just blackmailers and liars.

Also in a statement personally issued by him in Abuja, Melaye said the allegation “is the narrative of the attack dogs of demagogues who have decided to turn Nigeria upside down for failing to choose leaders for Senators. He said;
“It is pertinent to note that the incredulously machinated misinformation was orchestrated by forces bent on destabilising the upper chambers of the Nigerian Parliament for selfish reasons. “One of the mushroom and faceless online platforms used to promote the ill-fated and calumnious write-up has been notorious for serving as the propagandist machinery of political commercialists who are pushing for the extension of their fiefdom to the National Assembly. “While I remain unimpeachably committed to the leadership of the Senate, I believe the respected arm of government charged with the onerous responsibility of law making should be given the independence to conduct its business. “It is untrue and malicious; the allegation is the narrative of the attack dogs of demagogues who have decided to turn Nigeria upside down for failing to choose leaders for Senators. “I am a responsible Nigerian, role model and a champion of anti-corruption and equity which my party (APC) stands for. I therefore urge the general public to discountenance the libelous publication as I will continue to respect the history, culture and excellence of my Kogi West people on the floor of the Senate. The true threats to the current Republic are those who believe that a Nigeria that is not led by them must not exist.”

Nigeria’s unity is negotiable- Former Akwa Ibom state governor Victor Attah says



Former Akwa Ibom state governor, Victor Attah, says contrary to President Buhari’s position, Nigeria’s unity can be negotiated. President Buhari, during the Sallah holiday, had told a group of people who paid him a visit in the state house, that members of the various militant groups and Pro-Biafra group should stop their agitations as the unity of Nigeria cannot be negotiated.
In an interview with Vanguard, Attah said negotiation does not mean splitting of the country …
“You have to renegotiate. If you talk about renegotiation, some people think you want to split the country. No, it is like everytime they tell you to go and investigate somebody, you think it means you must go and find that person guilty. No, do not forget that they investigated Dr Alex Ekwueme and came back and said in fact, he was poorer than when he went in (to government). The people of Nigeria are dissatisfied with the current federal arrangement or whatever is binding them together now and are saying they want to renegotiate the terms of staying together.
The President quoted Gowon. Gowon had said that keeping Nigeria one is a task that must be achieved. That task was achieved by military means. He (Buhari) is not a military man now, he is a democrat, a politician. So, the only means politicians have is to negotiate. ‘So, what did you mean by you won’t negotiate? If you want to keep Nigeria one today, you must negotiate the terms and conditions of the people staying together and it goes back to the conference report, it goes back to the concept of fiscal federalism.
‘You would find out that in the final analysis, that is what everybody would be saying to you. Go and study as religiously as you can, the constitutions of 1960 and 1963. What is restructuring? Several people have used that word and have not been able to say what they mean. The few that have actually attempted to say what they mean either end up talking about going back to the regions as we had them before or adopting the six-zonal structure that had been proposed for Nigeria, which actually is in current usage but has not been sanctioned by the constitution of Nigeria. Others just use the word restructuring because it is almost like a buzz word, it is a popular thing to say now. ‘I do not want to be caught up in the semantics. I will subscribe, absolutely and entirely, to the concept of fiscal federalism. People ask what is the difference between fiscal federalism and restructuring and I will explain. I am convinced that fiscal federalism can be practised with even the 36 state-structure and one federal capital territory that we have today in Nigeria. In fact, I can say, it is a must, for there to be peace and harmony, understanding among the federating units”

N1.3bn Arms Cash: EFCC Detectives To Quiz Obanikoro’s Ex-ADC

Musiliu ObanikoroThe Economic and Financial Crimes Commission, EFCC, will tomorrow (Wednesday) question Lt. A.O Adewale, the former Aide de Camp to immediate past Minister of State for Defence, Senator Musiliu Obanikoro over the N1.299billion flown to the Akure Airport for Ekiti State Governor, Ayodele Fayose.
Lt. Adewale of the Nigerian Navy, has received an invitation to make himself available for interrogation at the EFCC headquarters in Abuja on Wednesday.
Mr. Adewale, as part of his responsibility as ADC, reportedly accompanied the former junior minister to deliver the cash, which was meant for the prosecution of the 2014 governorship election in Ekiti.
The cash is believed to have come from the arms procurement fund that was under the Office of the former National Security Adviser (ONSA), Sambo Dasuki.
The officer was on board a chartered aircraft with Registration No: HS125-800 5N-BMT belonging to Gyro Air Limited, which ferried the N1.299billion to Akure on June 17 and 18, 2014.
He was supposed to have reported last week at the EFCC headquarters but requested to report tomorrow after getting clearance from the Navy.
A source said: “We are expecting him on Wednesday. Our team of investigators is on standby to interact with the naval officer who was the ADC to Obanikoro.
“We took time to invite him because investigation has not reached his own curve. Now, as a star witness to the movement and the modus operandi of the ex-minister, we need to hear from him.
“We are interested in his role in the movement of the cash to Fayose’s associate”.
Meanwhile, it was learnt that Fayose’s associate, Abiodun Agbele, who allegedly collected the slush funds from Obanikoro, was said to have “cringed” when EFCC detectives confronted him with incontrovertible evidence.
Agbele, who is presently in EFCC custody, was said to be worried after being shown some damning bank tellers, which he personally signed.
He was just “cringing”, the source added.

Adeboye Visits Slain RCCG Preacher’s Family, Oby Ezekwesili Demands Speedy Justice

The General Overseer of the Redeemed Christian Church of God, RCCG, Pastor E. A. Adeboye, yesterday morning paid a visit to the family of the late Assistant Pastor of the Divine Touch Parish of the RCCG, Mrs Eunice Elisha, in Abuja.

This was the same day that a former Minister of Education, Mrs. Oby Ezekwesili called on the Federal Government and security agencies, particularly the police, to expedite action and bring to justice masterminds of the murder.
The forty-two-year-old mother of seven was killed in cold blood around Bazango-West area of Kubwa in the Bwari Area Council of the Federal Capital Territory, FCT, while evangelizing on Saturday morning.
Barely a day after the wife of the Vice-President, Mrs Dolapo Osinbajo, also a pastor of the RCCG, paid a condolence visit to the deceased’s husband and children, Adeboye visited the husband of the deceased, Pastor Olawale Elisha and the family around 6am to console them.
Meanwhile, the former minister and BringBackOurGirls campaigner tweeted at about 1.17pm on her personal handle, @obyezeks, that the government should act fast, not only on the murder of Mrs. Olawale, but, also resolve the murder of another woman in Kano two months ago for alleged blasphemy.
She wrote: “Two women-Bridget Agbahime and now, Eunice Elisha have been needlessly killed for their faith.
“The federal government and police owe them speedy justice.”

U.S Ambassador Will Present Video Evidence In s*x Scandal Allegations

The case of the three members of the House of Representatives accused of s*xual misconduct while on a training in the United states is taking a dramatic turn.
The allegations were made by U.S Ambassador James Entwistle against Samuel Ikon (PDP Akwa Ibom), Mohammed Gololo (APC Bauchi) and Mark Gbillah (APC, Benue) , and you can read the letter in which he made the allegations to the Speaker of the House of Reps here. The three honorables involved denied the allegations and even went as far as threatening legal action against the Ambassador. 
They’re accused of soliciting for s*x as well as sexually harassing a hotel staff. The House of Reps has begun an investigation and the public hearing will begin on Thursday.
Sources indicate that the U.S Ambassador will provide video evidence to back up the allegations on Thursday and it remains to be seen how the hearing will play out.
